US Court Mandates Freedom of Kilmar Abrego Garcia from Immigration Custody
A court has ruled the prompt release of Kilmar Abrego Garcia from immigration custody, finding his ongoing confinement lacks lawful basis.
"Since Abrego Garcia's return from erroneous detention in El Salvador, he has been taken back into custody, again without lawful authority," the judge stated in her order.
The situation stems from a mistaken removal to El Salvador in March, which the government later admitted was an mistake. Following his return to the United States to face human smuggling allegations, he was held in federal detention.
In her order, the judge noted that the government does not have a valid removal order, which effectively blocks them from removing Mr. Abrego Garcia "for now."
